Privacy policy

1. Controller

2. Hosting and server logs

This website is delivered via Cloudflare, Inc. (101 Townsend St, San Francisco, CA 94107, USA). When you visit it, Cloudflare processes technically necessary data such as IP address, time, requested page and browser information in order to provide the website securely and quickly (Art. 6 (1) (f) GDPR). Cloudflare is certified under the EU-US Data Privacy Framework; the EU standard contractual clauses also apply. No analytics or advertising cookies and no tracking services are used. Fonts are loaded from this server, not from Google.

3. Local storage in the browser

Your choice between light and dark mode is stored in your browser’s local storage (key kiawak-theme). The history of the AI assistant only stays in the browser for the duration of the visit (session storage). This data is not transmitted to Kiawak. The language (German or English) results from the address of the page and is not stored.

4. Contact form and confirmation e-mail

If you use the form, your details (name, company, e-mail, phone, message, type of request, language of the page) and the time are stored in order to handle your request (Art. 6 (1) (b) GDPR or your consent under (a)). The data is kept in a Cloudflare data store and deleted no later than 12 months after the request has been completed, unless statutory retention obligations apply. Lukas Köppl receives a notification with your details by e-mail, and you automatically receive a confirmation of receipt at the e-mail address you entered, in the language of the page. E-mails are sent via Cloudflare Email Service (Cloudflare, Inc.); if this is not available, via the e-mail service Resend (USA). The transfer is based on the EU standard contractual clauses or the EU-US Data Privacy Framework. To protect against misuse, your IP address is stored for no more than two hours to limit requests.

If you subscribe to the free weekly AI Update, Kiawak stores your e-mail address, the chosen language and the times of sign-up and confirmation (proof of your consent). The sign-up only becomes effective after you click the confirmation link in the e-mail sent to you (double opt-in); unconfirmed sign-ups are not used for sending. The newsletter is sent every Monday via Cloudflare Email Service as described in section 4. The content is compiled automatically with AI (see section 6) from public news sources; no personal data of subscribers is passed to the AI. No tracking pixels and no click tracking are used. You can unsubscribe at any time via the link in every e-mail; your data is then deleted immediately. Legal basis is your consent (Art. 6 (1) (a) GDPR). To protect against misuse, your IP address is stored for no more than two hours to limit sign-ups.

6. AI assistant on the website

Your questions to the AI assistant are transmitted to an AI model to be answered: Cloudflare Workers AI (Cloudflare, Inc.) or, once activated, primarily Anthropic PBC (548 Market St, San Francisco, CA 94104, USA) as provider of the model Claude; if Anthropic fails, Cloudflare Workers AI answers. The transfer to the USA is based on the EU standard contractual clauses or the EU-US Data Privacy Framework, insofar as the provider is certified there. The providers do not use the content to train their models. Kiawak does not store the conversations, only an anonymous count of usage; to protect against misuse, your IP address is stored for no more than 20 minutes to limit questions. Please do not enter sensitive personal data. Legal basis is Art. 6 (1) (f) GDPR (answering your questions). The answers are generated automatically and can contain mistakes.

7. Phone agent in the browser (“Call”)

The phone agent on the website uses your browser’s speech recognition and speech output. Depending on the browser, the browser manufacturer (e.g. Google or Apple) processes the voice recording for recognition. The recognised text is answered as described in section 6. Kiawak does not record any audio and does not store the conversation. Only if you explicitly request a callback after the conversation are your details stored together with the conversation text as described in section 4 and e-mailed to Lukas Köppl (Art. 6 (1) (a) and (b) GDPR).

8. AI phone agent

If you call Kiawak’s phone number and the AI phone agent is active, the call is handled via the telephony provider Twilio Inc. (101 Spear Street, San Francisco, CA 94105, USA; transfer based on the EU standard contractual clauses or the EU-US Data Privacy Framework). Twilio converts your speech into text and speaks the answers with a computer voice (Amazon Polly via Twilio). No audio recording of the call is stored. Your phone number and the recognised conversation text are transmitted to the AI model as described in section 6 to answer, stored as a call note for up to 90 days and e-mailed to Lukas Köppl with a short summary after the call so that your request can be handled (Art. 6 (1) (b) and (f) GDPR). To protect against misuse, your phone number is also stored for no more than two days to limit the number of calls per day. At the beginning the agent points out that it is a digital assistant. It makes no decisions with legal effect for you (no automated decision within the meaning of Art. 22 GDPR); your voice is not used for identification.

9. Admin area

For the login to the admin area a technically necessary cookie (kw_admin, 14 days) is set. It only concerns the operator of the website. To protect against password guessing, the IP address is stored for no more than 30 minutes during login attempts.

10. Your rights

You have the right to information, rectification, erasure, restriction of processing, data portability and objection, as well as to withdraw consent with effect for the future. You can also complain to a data protection supervisory authority, for example the Bavarian State Office for Data Protection Supervision (BayLDA).
